1. This is a formal notice which is issued by the Authority because it appears to them that there has been a breach of planning control, under section 171 (A) (1) (a) of the above Act, at the land described below. They consider that it is expedient to issue this Notice, having regard to the provisions of the development plan and to other material planning considerations.

2. The land affected

Land at Charles Lane, Crow, Ringwood, BH24 3DB shown edged red on the plan attached to this Notice.

3. The breach of planning control alleged

3.1 Without planning permission the material change of use of the land affected from agriculture to a mixed use comprising agriculture and:

  1. The stationing of caravans for recreational/residential/storage purposes; and
  2. The storage/siting of non-agricultural items and paraphernalia including trailer, carriage, horse box, porta-loo and domestic items.

3.2 Without planning permission the erection of a building shown in the approximate position coloured green on the plan attached to this Notice and the laying of a hardstanding shown in the approximate position coloured orange on the plan attached to this Notice.

4. Reasons for issuing this notice

It appears to the Authority that the above material change of use of the land has occurred within the last 10 years and the operational development (the erection of a building and laying of a hardstanding) has occurred within the last 4 years.

The caravans, building, hardstanding, non-agricultural items and paraphernalia are conspicuous and harmful to the intrinsic landscape character of the New Forest National Park without sufficient policy justification and would lead to pressures for further inappropriate developments. The developments harmfully contravene policies DP1, DP6, CP7 and CP8 of the adopted New Forest National Park Core Strategy and Development Management Policies DPD and paragraphs 56 and 115 of the National Planning Policy Framework.

The Authority do not consider that planning permission should be granted because conditions could not overcome the objections referred to above.

5. What you are required to do

  1. Cease the use of the land affected for for the stationing of caravans for recreational/residential/storage purposes.
  2. Remove the caravans from the land affected.
  3. Remove all non-agricultural items and paraphernalia including trailer, carriage, horse box, porta-loo and domestic items from the land affected.
  4. Demolish the building shown in the approximate position coloured green on the plan attached to this Notice to ground level and remove all subsequent materials and debris from the land affected.
  5. Remove the hardstanding shown in the approximate position coloured orange on the plan attached to this Notice and remove all subsequent materials and debris from the land affected.

Time for compliance: 6 weeks after this Notice takes effect.

6. When this notice takes effect

This Notice takes effect on 09/11/2015, unless an appeal is made against it beforehand.

You can appeal against this Notice, but any appeal must be received, or posted in time to be received by the Secretary of State before 09/11/2015. The enclosed leaflet from the Planning Inspectorate headed “THIS IS IMPORTANT” details what you must do should you wish to appeal. Read it carefully.

What happens if you do not appeal

If you do not appeal against this Enforcement Notice, it will take effect on 09/11/2015, and you must then ensure that the required steps for complying with it, for which you may be held responsible, are taken within the period(s) specified in the Notice. Failure to comply with an Enforcement Notice which has taken effect can result in prosecution and/or remedial action by the Authority.
