Mitigation checklist

Summary

AI generated summary
Checklist for planning applications in the New Forest National Park that create a net increase in homes or overnight accommodation. It requires applicants to confirm how they will avoid or mitigate impacts on protected sites so permission can be granted lawfully under habitat regulations. It covers nutrient mitigation due to high nutrient levels and eutrophication risk, offering options to provide a mitigation package secured by a Grampian condition, demonstrate nutrient neutrality with an attached nutrient budget, or acknowledge that permission cannot be granted without mitigation. It also requires recreation impact mitigation for New Forest SAC/SPA/Ramsar sites, usually via a financial contribution to the New Forest Recreation Mitigation Scheme or an agreed alternative approach. For development within 5.6 km of Solent designated sites, it requires Bird Aware Solent mitigation or an alternative. The form includes site details and a signed declaration by the applicant or agent.

Mitigation Checklist

This checklist must be completed and provided in relation to any planning application for a net increase in dwellings or providing additional overnight accommodation. It sets out how an avoidance and mitigation package will be provided to remove any likely significant effect on a designated site.

All relevant boxes should be completed and the form must be signed. If signed by an agent, it is their responsibility to ensure that the applicant is aware of the commitment to providing a mitigation package.

For more information regarding the impacts on the protected sites and the mitigation strategies in place, please refer to the NPA web page: Mitigating impacts on protected areas.

Nutrient Mitigation Strategy

Background

There is existing evidence of high levels of nutrients in the water environment with evidence of eutrophication at some designated sites. As such, there is considered to be a likely significant effect from residential (and similar) developments located within the New Forest National Park. As a result, an avoidance and mitigation package will be needed in order for the Authority to lawfully grant planning permission for such development.

In order for the development to comply with the requirements of the Conservation of Habitats and Species Regulations and for the Authority to lawfully be able to grant planning permission for such development, it will be necessary to impose a Grampian condition requiring the provision of an avoidance and mitigation package prior to the occupation of the development.

Please select one of the following options: Select
I hereby confirm that the proposed development will include an avoidance and mitigation package and confirm that I am content that a Grampian condition is used to secure this prior to occupation.
The proposed development would be ‘nutrient neutral’. A nutrient budget is attached to this checklist (this option is particularly applicable to developments proposed on agricultural land)
The proposed development is not nutrient neutral and no avoidance or mitigation package is proposed (please note that planning permission could not lawfully be granted in these circumstances).

New Forest Recreation Mitigation Scheme

Background

Much of the New Forest National Park is home to rare habitats and birds and has been designated as a Special Areas of Conservation (SAC), Special Protection Areas (SPA) and Ramsar (wetlands). Consequently, applicants and decision makers must consider how development proposals could impact these areas and ensure they are not adversely affected.

All new residential development and visitor accommodation throughout the New Forest National Park will require mitigation for their recreational impacts on these protected sites to ensure legal compliance.

Please select one of the following options: Select
I confirm that the proposed development will include an avoidance and mitigation package to accord with the New Forest National Park Revised Habitat Mitigation Scheme. This can take the form of a financial contribution towards the agreed New Forest Recreation Mitigation Scheme.
I propose an alternative approach to avoiding and mitigating the recreational impacts arising out of the development proposed (if this is the case please supply more detail in your supporting documentation).

Bird Aware Solent Recreation Mitigation Strategy

Background

All new residential development and visitor accommodation within 5.6 kilometres of the Solent SPA, SAC and Ramsar sites will also require mitigation for recreational impacts on these coastal designated sites.

The New Forest National Park Authority considers that mitigation provided in line with the Solent Recreation Mitigation Strategy (Our strategy - Bird Aware Solent) is appropriate to relevant planning applications.

In the absence of the avoidance and mitigation package the National Park Authority will not be able to lawfully grant planning permission.

Please confirm the first option and then select one of the two succeeding options: Select
The development is within 5.6 km of the Solent’s internationally designated sites.
I confirm that the proposed development will include an avoidance and mitigation package to accord with the Bird Aware Solent Recreation Mitigation Strategy. This can take the form of a financial contribution towards the agreed Mitigation Scheme.
I propose an alternative approach to avoiding and mitigating the recreational impacts arising out of the development proposed (if this is the case please supply more detail in your supporting documentation).

Declaration

Please select one of the following options to the right, then complete all boxes below Signed by applicant Signed by agent
